SUMMARY


  • The Trade Union Act 2016 will make significant changes to the law on industrial action, as well as affecting how public sector employers manage union facility time and check-off arrangements. It also changes the role and power of the Certification Officer.
  • Trade union law is not devolved and the Act will apply in Scotland, England and Wales. However, the devolved governments in Scotland and Wales have previously stated their opposition to the Act and indicated that they would try to challenge and/or minimise the impact of the reforms on devolved services.
