Overview


  • Before bringing an employment tribunal claim, claimants first have to submit details of their claim to ACAS, at which point they will be offered the option of early conciliation (EC). If EC is refused by either party, or is unsuccessful, the claimant will be able to make their tribunal claim.
  • The period for EC ends after one month, unless extended.
  • There are very limited circumstances where a claimant can go to tribunal without going through the EC process.
  • While the requirement for prospective claimants to contact ACAS before they can lodge tribunal proceedings is mandatory, the decision whether to accept the offer of EC is entirely voluntary.
  • The limitation periods that apply to bringing tribunal claims are extended to enable EC to take place.
